Terms + Conditions

Calm Mama Collective App is operated and wholly owned by Ellen Haines, Certified Hypnotist and Ellen Haines LLC.

By using these audio recordings and any other content within the app, you agree to be legally bound by these terms. These terms may be updated by us occasionally without notice to you. You should review the website every now and then for changes to these terms.

The Calm Mama Collective App terms of use serve to protect both parties by preventing confusion, misunderstanding, and to ensure we both act fairly. Please read carefully these terms of use which apply to your use of the Calmamacollective.mvt.so website and any downloads or other products that you use or purchase from it (together referred to as "the Site") because by accessing the Site you are agreeing to be legally bound by these terms. These terms may be updated by us from time to time without notice to you. You should review the Site periodically for changes to these terms.

We respect your privacy. Your contact information and certain other information about you is subject to our Privacy Policy.

Directions for use of Calm Mama Collective - IMPORTANT INFORMATION

The Site provides a number of spoken-word hypnosis and meditation recordings. Your purchase and/or use of any hypnosis audios is subject to and governed by these terms and any other conditions specified on the Site or in emails or other product information from us at the time of purchase. The Site is intended to help you benefit from the positive effects of hypnosis and meditation. While hypnosis and meditation are known to produce exceptional and consistently successful results in the ways described on the Site, it should not be used as a substitute for your doctor's role in monitoring your health.

The Site has not been evaluated by any government or official body. Nothing offered on or offline is intended to diagnose, cure or prevent any disease or disorder of any kind. If you are in any doubt over a health or emotional issue, you should seek the advice of your GP or professional advisor or therapist.

You must be 18 years of age or have parental consent before using this website, or any of our affiliates' products or services.

You must always follow the guidance notes and advice accompanying any downloads or content on the Site. When listening to hypnosis or meditation sessions, you must be in a place where you can safely relax. Never listen to hypnosis sessions while driving or operating machinery.

Intellectual Property Rights
The Site including all hypnosis and meditation audios or other content provided by us to you (together "Content") are all protected by our intellectual property rights, including but not limited to copyright and trade marks.

Except as expressly authorized by us, you may not copy, download, adapt, alter, modify, rent, lease, loan, sell, distribute, communicate or make available to the public or create derivative works of any Content, in whole or in part.

Dealings with Third Parties and Links
The Site may provide links to other web sites or resources. As we have no control over such sites and resources, we are not responsible for the availability of such external sites or resources, do not endorse and are not liable for any content, advertising, products, or other materials on or available from such sites or resources.

Any dealings by you with any third party on or through the Site shall be solely between you and that third party and, so far as permitted by law, we shall not be liable for any loss or damage which you may incur as the result of any such dealings.

Subscriptions

Some parts of the Service are billed on a subscription basis ("Subscription(s)"). You will be billed in advance on a recurring and periodic basis ("Billing Cycle"). Billing cycles are set either on a monthly or annual basis, depending on the type of subscription plan you select when purchasing a Subscription.

At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or movement.so cancels it. You may cancel your Subscription renewal either through your online account management page.

A valid payment method, including credit card, is required to process the payment for your Subscription. You shall provide Ellen Haines LLC with accurate and complete billing information including full name, address, state, zip code, telephone number, and a valid payment method information. By submitting such payment information, you automatically authorize Ellen Haines LLC to charge all Subscription fees incurred through your account to any such payment instruments.

Should automatic billing fail to occur for any reason, Ellen Haines LLC will issue an electronic invoice indicating that you must proceed manually, within a certain deadline date, with the full payment corresponding to the billingperiod as indicated on the invoice.

Free Trial

Calm Mama Collective may, at its sole discretion, offer a Subscription with a free trial for a limited period of time ("Free Trial"). You may be required to enter your billing information in order to sign up for the Free Trial. If you do enter your billing information when signing up for the Free Trial, you will not be charged by Ellen Haines LLC until the Free Trial has expired. On the last day of the Free Trial period, unless you cancelled your Subscription, you will be automatically charged the applicable Subscription fees for the type of Subscription you have selected.

At any time and without notice, Breakthrough Apps reserves the right to (i) modify the terms and conditions of the Free Trial offer, or (ii) cancel such Free Trial offer.

Fee Changes

Ellen Haines LLC, in its sole discretion and at any time, may modify the Subscription fees for the Subscriptions. Any Subscription fee change will become effective at the end of the then-current Billing Cycle. Ellen Haines LLC will provide you with a reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such change becomes effective.

Your continued use of the Service after the Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.

Refunds

Except when required by law, paid Subscription fees are non-refundable.

Accounts

When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Termination

We may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach the Terms. All provisions of the Terms shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

Disclaimers

Your use of the our hypnosis recordings and apps is at your sole risk.

Disclaimers & Liability

So far as permitted by law, and except in respect of death or personal injury arising from negligence, our liability for loss or damage of any kind resulting from the use of our hypnosis recordings or any content, advertisements or products provided or distributed through the website or other channels or our websites including, without limitation, economic loss or any special, indirect, incidental or consequential loss or damage, whether or not the possibility of such loss has been notified to us shall be limited to the aggregate purchase price of your hypnosis apps and downloads. The foregoing will apply whether such loss or damage arises in contract, negligence, under statute or otherwise. Nothing in these terms affects any liability for fraudulent misrepresentation.

General Information

These terms constitute the entire agreement between you and us. Any failure by us to exercise or enforce any provision of these terms shall not constitute a waiver of such provision. The Owner reserves the right to modify these Terms at any time, informing Users by publishing a notice within this Website. Users who continue to use this Website after the publication of the changes accept the new Terms in their entirety.

These Terms and any dispute concerning the implementation, interpretation and validity of this agreement are subject to United States’ law.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, in whole or in part, please stop using the website and the Service.
